29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) 39602 Waterworks Court Bethany Beach, DE - On or about November 2, 2020, the employer was unable to completely terminate the work being performed on an aerial lift prior to wind speeds exceeding the manufacturer�s instructions, where employees who were not certified operated a Genie Aerial Lift Model Z-135/70. Among other methods, feasible and acceptable methods to correct the hazard include: (1) Follow the manufacturer�s instructions regarding wind while operating aerial lifts. (2) Follow the requirements established by the manufacturer including but not limited to ANSI standards which would ensure all workers who must operate the equipment are certified in the operation of aerial lifts. Pursuant to 29 CFR 1903.19, the employer must submit abatement certification and documentation, required within 15 days after the abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photograph or video evidence of abatement or other written records.
