29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a)Kwik-Way at 800 South Marion Road in Sioux Falls, SD 57106: On or about and at times prior to November 3, 2020, the employer did not ensure employees were protected from chemical hazards and hazards associated with respirator use in that a written respiratory protection program was not developed and implemented covering employees that are required to wear respiratory protection when performing work.  One employee was required to wear a 3M half mask respirator when applying coatings that contain hazardous chemicals. This condition exposed one employee to chemical hazards and hazards associated with respirator use.   Abatement Note:  Abatement certification is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR  1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form:   (a)Kwik-Way at 800 South Marion Road in Sioux Falls, SD 57106: On or about and at times prior to November 3, 2020, the employer did not ensure employees were protected from chemical hazards from coating and welding activities in that the employer did not evaluate respiratory hazards to which employee were exposed when performing these activities. 29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a)Kwik-Way at 800 South Marion Road in Sioux Falls, SD 57106: On or about and at times prior to November 3, 2020, the employer did not ensure employees were protected from hazards associated with use of respiratory protection, in that one employee was not provided a medical evaluation prior to being required to wear a 3M half mask respirator when performing work. This condition exposed one employee to hazards associated with use of  respiratory protection .
