29 CFR 1926.20(b)(2): The employer did not initiate and maintain an accident prevention program which provided for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):  (a)Chuck's Roofing and Construction at 1001 South Burr Street, Mitchell, SD 57301: On or about and at times prior to October 29, 2020, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.  Employees were exposed to fall hazards of approximately 8 feet while conducting roof tear off operations and installing roofing materials with inadequate fall protection systems.  The condition exposed employees to a fall hazard greater than 6 feet.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR  1926.102(a)(1):Employees were not provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents:  (a) Chuck's Roofing and Construction at 1001 South Burr Street, Mitchell, SD 57301: On or about and at times prior to October 29, 2020, the employer did not ensure that each employee that was installing asphalt shingles on a commercial property with the use of a pneumatic nail gun was protected from flying particles by the use of appropriate eye protection.

29 CFR  1926.501(b)(1):Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a) Chuck's Roofing and Construction at 1001 South Burr Street, Mitchell, SD 57301: On or about and at times prior to October 29, 2020, the employer did not ensure that employees were protected from falls while conducting tear off and roofing operations.  Employees were installing asphalt shingles and conducting tear off operations on a commercial facility with no fall protections systems in place.  This condition exposed employees to fall hazards greater than six feet.

This condition exposed employees to fall hazards of approximately eight feet.

This condition exposed employees to fall hazards of eight feet associated with improper set up of the ladder.
