On or about November 3, 2020, and at times prior thereto, the employer did not ensure that the operator of the Backhoe 420F Caterpillar had acquired the knowledge and skills necessary to safely operate the equipment, exposing employees to hazards such as, but not limited to being struck by the backhoe and falling loads.

29 CFR 1926.50(c): In the absence of an infirmary, clinic, hospital, or physician, that is reasonably accessible in terms of time and distance to the worksite, which is available for the treatment of injured employees, a person who has a valid certificate in first-aid training from the U.S. Bureau of Mines, the American Red Cross, or equivalent training that can be verified by documentary evidence, was not available at the worksite to render first aid. On or about November 3, 2020, and at times prior thereto, four employees were performing construction work at a remote housing development site in which a first-aid trained person was not readily available, exposing the workers to the hazard of delayed immediate life support services being administered.

On or about November 3, 2020, and at times prior thereto, an employee was guiding a backhoe into position while standing in the public road way without a reflective vest or other high-visibility garments, exposing the employee to the hazard of being stuck by road way vehicles.
