29 CFR 1926.50(g): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use: a. On Bridge #610079, located on State Road 77 in Chipley, Florida: On or about October 27, 2020, the employer exposed employees to eye injuries and chemical burn hazards, in that employees mixing the three (3) components of Transpo Industries Sealate� T-70 HMWM Crack Sealer did not have a suitable portable eyewash station at the jobsite.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets: a. At Bridge #610079, located on State Road 77, in Chipley, Florida: On or about October 27, 2020, the employer exposed employees to eye injuries and burn hazards, in that employees were not provided with effective information and training on the proper mixing of the three (3) components used in Transpo Industries Sealate� brand T-70 HMWM Crack Sealer, known by OSHA to be a hazardous chemical. OR IN THE ALTERNATIVE: 29 CFR 1926.59: The employer did not follow the requirements applicable to construction work under this section that are identical to those set forth at 1910.1200 of this chapter.
