29 CFR  1910.134(c)(1): In any workplace where respirators are necessary to protect the health of the employee or whenever respirators are required by the employer, the employer shall establish and implement a written respiratory protection program with worksite-specific procedures. The program shall be updated as necessary to reflect those changes in workplace conditions that affect respirator use. The employer shall include in the program the following provisions of this section, as applicable:    a. On or about November 19, 2020, a respiratory protection program was not implemented to require the use of a respirator to protect employees from being overexposed to nuisance dust while repairing truck tanks. The employer did not ensure that employees required to use a respirator were medically able to use that respirator, were fit tested to ensure the respirator correctly fit and were properly trained to ensure the respirator was properly used, stored and maintained.

29 CFR  1910.1000(a)(2): Other substances -- 8-hour Time Weighted Averages. An employee's exposure to any substance in Table Z-1, the exposure limit of which is not preceded by a "C", shall not exceed the 8-hour Time Weighted Average given for that substance any 8-hour work shift of a 40-hour work week.     On or about November 19, 2020, an employee welding inside of a truck tank and acting as an attendant for grinding was exposed to respirable nuisance dust in excess of the 8-hour time weighted average limit (TWA) for the permissible exposure limit provided in Table Z-1:  a. An employee performing tank repair duties was exposed to an 8-hour TWA for respirable nuisance particles of 7.8 milligrams per cubic meter air during a 312 minute sampling period. This exposure level was 1.56 times the calculated permissible exposure limit of 5.00 milligrams per cubic meter air. Zero exposure was assumed for the 168 minutes that were not sampled.

29 CFR  1910.1000(e): To achieve compliance with paragraphs (a) through (d) of this section, administrative or engineering controls must first be determined and implemented whenever feasible. When such controls are not feasible to achieve full compliance, protective equipment or any other protective measures shall be used to keep the exposure of employees to air contaminants within the limits prescribed in this section. Any equipment and/or technical measures used for this purpose must be approved for each particular use by a competent industrial hygienist or other technically qualified person. Whenever respirators are used, their use shall comply with 1910.134. [71 FR 16673, April 3, 2006]   On or about November 19, 2020, an employee working in the tank area was exposed to respirable nuisance dust in excess of the 8-hour time weighted average limit (TWA) for the permissible exposure limit provided in Table Z-1:  a.
