29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  On or about November 5, 2020 the employer was observed using a field designed wooden platform on a Genie GTH Telehandler forklift 25 feet high as a scaffold platform for personnel to perform residential construction activities. The Genie forklift was not equipped to lift personnel nor to be used as a attached platform, exposing employees to fall and struck-by hazards.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section.  On or about November 5, 2020, employees were exposed to fall hazards approximately 25 feet high while standing on a wooden scaffold platform to perform residential construction activities. Fall protection was not being utilized while performing construction operations.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about November 5, 2020, employees were exposed to fall hazards approximately 25 feet high while engaged in residential construction activities.  Fall protection was not being utilized while performing construction operations.     Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards:   On or about November 5, 2020, employees performing construction work at a residential property were exposed to fall hazards approximately 25 feet with no fall protection when the employer failed to ensure they were adequately trained to recognize and minimize the hazards associated with fall.    Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  On or about November 5, 2020, the employer operated a Genie Telehandler forklift without ensuring that he had successfully completed powered industrial truck operator training consisting of a combination of formal instruction through computer based training, videos, written exercises, etc. and an evaluation of operating performance (driving test) in the workplace. Employees were exposed to struck-by injuries.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d)
