29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. (a) Longleaf Apartments: On October 24, 2020 and at times prior thereto the employer exposed employees to fall hazards in that employees were elevated to the roof while standing on a plywood box not approved for personnel use that was attached to the forks of all terrain forklift.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Longleaf Apartments: On November 4, 2020 and times prior thereto the employer exposed employees to fall hazards by allowing employees to use a portable ladder to access a upper landing surface without extending the portable ladder side rails at least 3 feet (9m) above the upper landing surface being accessed. The employees were exposed to fall hazards of 20 feet 2 inches to the ground below when using the ladder.
