29 CFR 1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. a.) On or about November 5, 2020, the employer failed to conduct an adequate job site inspection by a competent person in that the ground in front of the north west portion of the building was not inspected to determine if it was level and capable of supporting the load of an elevated extensible and articulating boom platform aerial lift.

29 CFR 1926.454(b):The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question. a.) On or about November 5, 2020, employees were not trained on how to operate a SkyJack SJ86T Telescopic Boom aerial lift nor were they made aware of the hazards associated with operating the aerial lift on a sloped surface which resulted in the aerial lift tipping over and injuring both employees.
