29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.  On or about November 3, 2020, at the above addressed jobsite, an employee performing residential roofing operations, eight (8) feet ten (10) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  b.  On or about November 3, 2020, at the above addressed jobsite, an employee performing residential roofing operations, nine (9) feet above the ground, was not protected from falls, thereby exposing the employee to fall hazards.  c.  On or about November 3, 2020, at the above addressed jobsite, employees performing residential roofing operations, seventeen (17) feet nine (9) inches above the ground, were not protected from falls, thereby exposing the employee to fall hazards.  d.  On or about November 3, 2020, at the above addressed jobsite, an employee performing residential roofing operations, eighteen (18) feet four (4) inches above the ground, was not protected from falls, thereby exposing the employee to fall hazards.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a.  On or about November 3, 2020, at the above addressed jobsite, a portable extension ladder used to access the roof did not extend at least three (3) feet above the upper landing surface, thereby exposing an employee to hazards associated with falls from a maximum height of nine (9) feet.  b.  On or about November 3, 2020, at the above addressed jobsite, a portable extension ladder used to access the roof did not extend at least three (3) feet above the upper landing surface, thereby exposing an employee to hazards associated with falls from a maximum height of eighteen (18) feet four (4) inches.

On or about November 3, 2020, at the above addressed jobsite, employees had been provided fall training, however, the employer failed to keep a written certification of record.
