29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  (a)  At 11885 Lodgepole Ct., Lot 67 Savannah Woods, Spanish Fort, Alabama:  On or about November 6, 2020 and at times prior; the employer allowed his employee to perform roofing activities without fall protection exposing his employee to a fall hazard of up to 11.4 feet to the ground below.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a)  At 11885 Lodgepole Ct., Lot 67 Savannah Woods, Spanish Fort, Alabama:  On or about November 6, 2020 and at times prior; the employer allowed his employee to perform roofing activities without first ensuring his employees were trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employee to a fall hazard of up to 11.4 feet to the ground below.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   a)  At 11885 Lodgepole Ct., Lot 67 Savannah Woods, Spanish Fort, Alabama:  On or about November 6, 2020 and at times prior; the employer allowed his employee to use an exention ladder to gain access to the roof and the rails of the ladder did not extend at least three feet above the roof landing to provide safe access  exposing his employee to a fall hazard of up to 11 feet to the ground below.
