29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:     a)  At 10558 Eastern Shore Center, Bldg. 700 The Arlington @ Eastern Shore Center, Spanish Fort, Alabama:  On or about November 5, 2020 and at times prior; the Controlling employer, JRC Incorporated,  failed to ensure its subcontractor, Jonathan Restoration, Inc., protected employees  fall hazards of 10.2 feet to the ground below in that employees were permitted to use an extension ladder to gain access to the first level eyebrow roof and the rails of the ladder did not extend at least three feet above the roof landing to provide safe access and egress.  b)  At 10558 Eastern Shore Center, Bldg. 900 The Arlington @ Eastern Shore Center, Spanish Fort, Alabama:  On or about November 5, 2020 and at times prior;  the Controlling employer, JRC Incorporated,  failed to ensure its subcontractor, Milton Ariel Rivas, protected employees from fall hazards of 21.8 feet to the ground below in that  employees were permitted to use an extension ladder to gain access to the second level roof and the rails of the ladder did not extend at least three feet above the roof landing to provide safe access and egress.  c)  At 10558 Eastern Shore Center, Bldg. 700 The Arlington @ Eastern Shore Center, Spanish Fort, Alabama:  On or about November 5, 2020 and at times prior; the Controlling employer, JRC Incorporated,  failed to ensure its subcontractor, Jonathan Restoration, Inc., protected employees from fall hazards of 21.8 feet to the ground below in that  employees were permitted to use an extension ladder to gain access to the second level roof and the rails of the ladder did not extend at least three feet above the roof landing to provide safe access and egress.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 10558 Eastern Shore Center, Bldg. 700 The Arlington @ Eastern Shore Center, Spanish Fort, Alabama:  On or about November 5, 2020 and at times prior; the Controlling employer, JRC Incorporated, failed to ensure that its subcontractor, Jonathan Restoration, Inc., trained its employees  on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 21.8 feet to the ground below.  b)  At 10558 Eastern Shore Center, Bldg. 900 The Arlington @ Eastern Shore Center, Spanish Fort, Alabama:  On or about November 5, 2020 and at times prior; the Controlling employer, JRC Incorporated, failed to ensure that its subcontractor, Jonathan Milton Ariel Rivas, trained its employees  on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employees to a fall hazard of up to 21.8 feet to the ground below.
