29 CFR  1910.147(c)(1):The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  On or about 11/9/20, the employer failed to create, implement, and maintain a lockout/tagout program. Employees were conducting maintenance, repair, and cleaning tasks on machinery including, but not limited to the following:  a) Line #1 on the third floor, types of energy include pneumatic, electric, and thermal, b) Line #2 on the third floor, types of energy include pneumatic, electric, and thermal, and c) The Automatic Capsule Filling Machine, Model # TES-1200, serial # 121402. Types of energy include pneumatic, and electric.

29 CFR  1910.212(a)(1):One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  On or about 11/19/20 the employer failed to ensure that machine guarding methods were utilized. The Omega Design Corporation Model 3D-ERP2-10, serial # 98-J23523, had a bypassed safety interlock exposing employees to pinch points, caught in, and struck by hazards.

29 CFR  1910.219(c)(3):Vertical or inclined shafting seven -7 feet or less from floor or working platform was not enclosed with stationary casing(s):  On or about 11/9/20, the employer failed to ensure that the vertical shaft of the Cappers on Lines #1 and #2 were guarded by an enclosure. The rotating shafts were about 3.5' from the floor.
