The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. Hillcrest Care Center, LLC located at 1008 Clarke Street, De Soto, Missouri: On or about 10/27/2020, the employer did not provide a medical evaluation to workers who were required to wear N95 respirators while providing care to residents with with suspected or confirmed COVID-19 infection.

29 CFR 1910.134(f)(2):Employees using tight fitting face piece respirators were not fit tested prior to initial use of the respirators: a) Hillcrest Care center, LLC located at 1008 Clarke Street, De Soto, Missouri: On or about 10/27/2020, the employer did not provide fit testing to employees who wore N95 respirators. The employer required employees to wear N95 respirators for protection against the SARS-CoV-2 virus while providing care to suspected or confirmed positive COVID-19 residents.
