29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d): On or about November 12, 2020, and at times prior thereto, employees were exposed to a struck-by hazard while a rough terrain forklift was used to carry roofing material without the operator being trained on it's safe operation by the employer.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. On or about November 12, 2020, and at times prior thereto, employees were exposed to a fall hazard greater than 15 feet to the ground below while installing metal decking without using a personal fall arrest system.
