29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles. The employer is failing to protect employees from eye injuries when operating pneumatic nail guns. This was most recently documented on or about November 13, 2020 at 5520 J Street, Lincoln, Nebraska when employees were observed shingling a residential structure. Employees were operating pneumatic nail guns while shingling a roof without the use of eye protection.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: The employer is failing to protect employees from fall hazards when conducting roofing operations on a residential structure. This was most recently documented on or about November 13, 2020 at 5520 J Street, Lincoln, Nebraska when employees were observed working on a residential structure with a roof pitch greater than 4:12. The employees where installing shingles while working at a height of approximately 8 feet 10 inches measured from the ground to eave without fall protection.
