29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step. On or about November 12, 2020 at the jobsite located at 1760 Steve Reynolds Industrial Parkway in Commerce, Georgia, employees working inside the VD Room (ceiling of battery production building), were engaged in pipe fitting work while using a 12 foot "A" frame ladder, were exposed to a fall hazard at approximately 9 feet 9 inches to ground level, in that the employer did not ensure employees did not use the top steps to access the area.
