29 CFR  1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii):  New townhome construction located on Lot #175 Catamaran Court, Alpharetta, GA, Front side of the structure:  On or about 11/13/2020, employees engaged in masonry activities were exposed to fall hazards while working from a single plank scaffold at heights of approximately 28-feet, from the top of the plank to the lower (ground) level.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access:   New townhome construction located on Lot #175 Catamaran Court, Alpharetta, GA, Front side of the structure:  On or about 11/13/2020, the employer exposed employees to a fall hazard of approximately 21-feet, 4-inches in that, a ladder or other safe means of access was not provided to employees using a tubular welded scaffold system to install bricks.

29 CFR  1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    (a) New townhome construction located on Lot #175 Catamaran Court, Alpharetta, GA, Front side of the structure: On or about 11/13/2020, the employer exposed employees to fall hazards of 14-feet, 9-inches to the lower ground level in that, a fall protection system was not provided to employees using a tubular welded scaffold system to install bricks to the exterior of the structure. The platforms were not provided with guardrails or other fall protection systems.  (b) New townhome construction located on Lot #175 Catamaran Court, Alpharetta, GA, Front side of the structure: On or about 11/13/2020, the employer exposed employees to fall hazards of 21-feet, 4-inches to the lower ground level in that, a fall protection system was not provided to employees using a tubular welded scaffold system to install bricks to the exterior of the structure. 29 CFR  1926.602(d):The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l):  New townhome construction located on Lot #175, Front side of structure:  On or about 11/13/2020, and at times prior, the employer exposed employees to struck-by hazards in that, employees were operating a JCB 509-42 All-Terrain Forklift Truck without first receiving training and certifications to operate this equipment. Uncertified operators were in close proximity to others working on scaffold systems and the ground area below.
