29 CFR 1910.178(a)(4):Modifications or additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: a) Warehouse: On or about 11/12/2020, and at times prior, the employer exposed employees to struck-by hazards, in that they were using a Cascade attachment (CAT# 15D-CCS-1420, SER# 187536-06) on a Mitsubishi propane lift (Model# FGC25, SER# AF82B-06128) without the prior approval of the manufacturer. The forklift and attachment were used to move materials throughout the warehouse. b) Warehouse: On or about 11/12/2020, and at times prior, the employer exposed employees to struck-by hazards, in that they were using a Cascade attachment (SER# 2216C5-000411) on a Nissan propane lift (Model# CPH01A15V, SER# CPH01-920029) without the prior approval of the manufacturer. The forklift and attachment were used to move materials throughout the warehouse. c) Warehouse: On or about 11/12/2020, and at times prior, the employer exposed employees to struck-by hazards, in that they were using a Cascade attachment (CAT# 50D-BCB-55A RO, SER# 208557-02 RO) on a Mitsubishi propane lift (Model# FGC25N, SER# AF82F-32285) without the prior approval of the manufacturer. The forklift and attachment were used to move materials throughout the warehouse.

The lift did not have the parking brake set and the shifter was in forward gear.

29 CFR 1910.184(c)(1):Sling(s) that were damaged or defective were used: a) Warehouse; Warper: On or about 11/12/2020, and at times prior, the employer exposed employees to struck-by hazards, in that slings used to stabilize the large spools that were transported to the Warper machine for installation were frayed and severely damaged. The employer failed to take the slings out of service and replace the synthetic fiber slings when they were damaged.
