29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) Worksite, 351 West Montauk Highway, Lindenhurst, New York 11757:  On or about November 06, 2020, Employees were walking directly under ongoing roofing work and did not have head protection.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) Worksite, 351 West Montauk Highway, Lindenhurst, New York 11757:  On or about November 06, 2020, an employee was using an aluminum extension ladder to access the  working level at approximately 20-feet above the ground below. The ladder side rails extended approximately 24-inches above the landing surface.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) Worksite, 351 West Montauk Highway, Lindenhurst, New York 11757:  On or about November 06, 2020, Employees were performing roofing work along the edges of a residential building approximately 20-feet above the ground and were not protected from falling.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
