The employees conducted framing work for a residential home on the scaffold but the scaffold did not have guardrails. This condition exposed employees to a fall of approximate 14.7 feet.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  (a) Gerry Dalton Construction at 1032 Ranch View Road, Grand Junction, CO: On and before November 17, 2020: the exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding.  The scaffold used on the building lacked midrails and endrails. This condition exposed employees to a fall of approximate 14.7 feet.

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  (a) Gerry Dalton Construction at 1032 Ranch View Road, Grand Junction, CO: On and before November 17, 2020: the exposing employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize those hazards associated with the type of scaffold being used and to understand the procedure to control or minimize those hazards. Employees were conducting framing work, while working on a scaffold without guardrails. This condition exposed employees to a fall of approximate 14.7 feet.   Abatement Note: The training shall include the following elements at a minimum: a)  The nature of any electrical hazards, fall hazards, and falling object hazards in the work area b)  The correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling the fall protection systems and falling object protection systems being used c)  The proper use of the scaffold, and the proper handling of materials on the scaffold d)  The maximum intended load and the load-carrying capacities of the scaffold used; and e)  Any other pertinent requirements of this subpart.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) Gerry Dalton Construction at 1032 Ranch View Road, Grand Junction, CO: On and before November 17, 2020: the exposing employer did not ensure that employees were provided a training program for each employee exposed to fall hazards  to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. Three employees conducted framing work on a residential roof but were not provided any fall protection systems or any training  about fall hazards. This condition exposed employees to a fall of approximate 21 feet.   Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas: a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.

29 CFR  1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support:  (a) Gerry Dalton Construction at 1032 Ranch View Road, Grand Junction, CO: On and before November 17, 2020, the exposing employer did not ensure that a portable step ladder, which was partially folded  and could not extend side rails at least 3 feet above the roof surface due to ladder length, was secured at it's top to a rigid support that would not deflect. An employee used a step ladder in the partially closed position to access a roof. The employees had not been training that the step ladder was not designed for the purposes to accessing roofs and should only be used in the fully opened position with the spreader assembly fully extended. The employees had not been trained that the side rails of a portable ladder must extend at least 3 feet about the roof surface or be secured to a rigid support and that a grasping device must be provided to assist in mounting and dismounting the ladder. This condition exposed an employee to a fall of approximate 10.6 feet.

29 CFR 1926.95(d)(1): The protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employees:  (a) Finley, LLC at 1570 Grove St., Denver, CO: On and around March 25, 2020, personal protective equipment was not provided by the employer at no cost to the employees in that the employer required employees to purchase their own personal protective equipment, including but not limited to safety glasses, hard hats, and work gloves. This condition potentially exposed employees to struck-by and caught-between hazards, while conducting framing work.
