29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  On or about November 18, 2020 the employer was operating a powered industrial truck prior to receiving training and certification, exposing employees to struck-by hazards.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
