29 CFR 1910.176(a): Where mechanical handling equipment was used, sufficient safe clearances was not allowed for aisles, at loading docks, through doorways and wherever turns or passage were made. Aisles and passageways were not kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways were not appropriately marked. a) On or about 11/18/2020, in the baler area where fork truck was used on daily basis and where baled cardboard were stacked three tier high, the floors were not marked to keep workers from walking near stacked bales of cardboard. On the date above, the top bale of cardboard fell on a worker causing severe injuries.

29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse. On or about 11/12/2020, in the Baler area, bales of cardboard were not stacked in a stable manner. The top bale of cardboard stacked three tier high fell on a worker causing injuries to the worker.

29 CFR 1910.178(c)(2)(vi)(a): The employer did not provide powered industrial trucks designated as EX for use in an atmosphere in which combustible dust is or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced. On or about 11/18/2020, in the baler area, where combustible cardboard dust was maybe present, an un-approved Liquid Petroleum powered fork truck was used to move, stack and load bales of cardboard.
