29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a. Front Portion of the property:  An employee was  working inside a trench excavation measuring approximately 7.5 ft. long, 2.5 ft. wide, and 5.5 ft. deep without  having access to a ladder, stairs or ramp to safely enter and exit the trench; on or about 11/19/2020.   Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.651(j)(2):Employees were not protected from excavated or other materials or equipment that posed a hazard by falling or rolling into excavations and protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:  a. Front of the Property:  An employee was working inside a trench excavation approximately  7.5 ft. long, 2.5 ft. wide, and 5.5 ft. deep  below a spoil pile and other construction materials that was approximately 1.33 ft. from the edge of the trench excavation; on or about 11/19/2020.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

Front of the property: Employees were exposed to cave-in hazards while engaged in trenching excavation operations at the worksite.  An employee was working inside a trench measuring approximately 7.5 ft. long, 2.5 ft. wide, and 5.5 ft. deep without protection from an adequate shoring protection system; on or about 11/19/2020.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
