29 CFR  1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards, ladder safety hazards, and personal protective equipment hazards.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, employees were operating pneumatic nail guns without utilizing safety glasses while installing roofing materials, exposing employees to eye and face hazards from flying particles.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.  On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, employees were using a telescoping ladder to access and egress a roof surface ten feet above surface level without the side rails extended at least three feet above the roof surface.  The side rails were extended 12 inches above the eave edge, exposing employees to fall hazards.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a)  On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, two employees were working on a roof surface 15 feet above surface level without utilizing fall protection equipment.  b)  On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, one employee was working on a roof surface ten feet above surface level without utilizing fall protection equipment.

On November 20, 2020 at 1165 Christian Street in Oshkosh, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards when walking/working on a roof surface with unprotected edges.
