29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   (a) At the workplace, the employer did not have a written respiratory program for employees who were provided and required to use of N95 filtering facepiece respirators (FFRs) to prevent exposure to communicable diseases such as but not limited to tuberculosis, methicillin-resistant staphylococcus aureus (MRSA), coronavirus, influenza, etc.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  (a) At the workplace, each employee who were provided and required to wear N95 filtering facepiece respirators(FFRs) to prevent exposure to communicable diseases such as but not limited to tuberculosis, methicillin-resistant staphylococcus aureus (MRSA), coronavirus, influenza, etc., were not provided with medical evaluations.

29 CFR  1910.134(f)(2):The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:  (a) At the workplace, each employee who were provided and required to wear N95 filtering facepiece respirators(FFRs) to prevent exposure to communicable diseases such as but not limited to tuberculosis, Methicillin-resistant Staphylococcus aureus (MRSA), coronavirus, influenza, etc., were not fit tested prior to initial use of the respirator.
