29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to 93% to 99% sulfuric acid spills. a) On or about 11/13/2020, at the 25,000 gallon sulfuric acid tanks, employees were exposed to sulfuric acid leaks due to the tanks being overfilled past the employer's established safety factor.

29 CFR 1910.132(f)(1)(ii): The employer did not provide training to each employee who is required by this section to use PPE on knowing what PPE is necessary: a) On or about 11/13/2020, at Sulfuric Acid Tank 3, employees involved in cleaning up a sulfuric acid spill were not adequately trained to select the correct type of personal protective equipment necessary for handling sulfuric acid spills.
