29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about November 24, 2020, employees did not utilize eye protection while operating Milwaukee impact drills  to connect and set purlins and rafters. Employees were thereby exposed to struck-by hazards associated with metal fragments and particles as well as nuts and bolts.

29 CFR  1926.453(b)(2)(iv): Employee(s) working in an aerial lift were not standing firmly on the floor of the basket:  a. On or about November 24, 2020, employees were observed operating a JLG aerial boom lift to set purlins on the front side of the steel structure  in which they were building. Employees were observed climbing the sides of the aerial lift to work as well as climbing the sides and out of the lift onto the beams to perform their work.  b. On or about November 24, 2020, an employee was observed working alongside another employee in a JLG aerial boom lift to set purlins on the backside of the steel structure in which they were building. The employee was observed climbing up the sides of the aerial lift to work as well as climbing the sides and out of the lift onto the beams above to perform their work.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).  a. On or about November 24, 2020, employees were observed working from a JLG aerial boom lift without the use  of a personal fall arrest system with a lanyard attached to the aerial lift. As a result, employees were exposed to falls of approximately 24 feet.

29 CFR  1926.760(b)(3): Each connector working at heights over 15 and up to 30 feet above a lower level, was not provided with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or was not provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section.   a. On or about November 24, 2020, employees were setting purlins  and rafters for a new-construction building without wearing the equipment necessary to be able to be tied off. As a result, the employees were exposed to fall hazards of approximately  24 feet.
