29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles.   On or about October 30, 2020, and at times prior thereto, employees operating Hitachi nail guns while performing roofing activities were not wearing eye protection, exposing employees to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about October 30, 2020, and at times prior thereto at 2811 Chesterfield Ln, Venus TX 76084 engaged in framing activities were not provided fall protection and exposed to an unprotected fall hazard approximately 11 feet.  The Sergio Compean Medina was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1288127, citation number 1, item number 2 and was affirmed as a final order on 11/12/2019, with respect to a workplace located at 3306 Woodford Dr. Mansfield, TX 76063.

On or about October 30, 2020, and at times prior thereto at 2811 Chesterfield Ln. Venus TX 76084 employees engaged in framing activities were exposed to fall hazards and the employer did not provide a training program nor formal certification records of the training.

29 CFR  1926.503(c): When the employer has reason to believe that any affected employee who has already been trained does not have the understanding and skill required by paragraph (a) of this section, the employer is to retrain each such employee such as inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding of skill.     On or about October 30, 2020, and at times prior thereto at 2811 Chesterfield Ln. Venus TX 76084, employees engaged in framing activities were  exposed to fall hazards and the employer did not correct and retrain the employees where they demonstrated inadequacies in understanding and applying the skills necessary to remove fall hazards.
