OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and crushing hazards associated with two-post and four-post automotive lift failure due to deficiencies not identified as a part of conducting annual inspections:  (a)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020, the employer did not inspect the Revolution Lift, Model #RTP10N200BBL, for defects in that employees were exposed to struck-by and crushing hazards from falling loads from a safety latch system being bypassed. This condition exposed employees to struck-by and crushing hazards.   (b)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020 the employer did not establish a periodic inspection cycle for the Challenger, Model # LE10, automotive lift within the shop and ensured the lift was inspected at least annually by a qualified lift inspector. This condition exposed employees to struck-by and crushing hazards.   (c)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020 the employer did not establish a periodic inspection cycle for the Challenger, Model # CL9 ,automotive lift within the shop and ensured the lift was inspected at least annually by a qualified lift inspector. This condition exposed employees to struck-by and crushing hazards.   (d)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020 the employer did not establish a periodic inspection cycle for the Challenger, Medium Duty Four-Post Lift, Model # 44018/44018E, automotive lift within the shop and ensured the lift was inspected at least annually by a qualified lift inspector. This condition exposed employees to struck-by and crushing hazards.    Abatement Note: Among others, the following are feasible and acceptable abatement methods to abate the hazard:  1) Institute a preventative maintenance program in accordance with ANSI/ALI ALOIM.  2) Ensure employees do not use automotive lifts with deficient safety devices.  3) Ensure unsafe lifts are effectively locked out until repairs can be made by qualified personnel.

29 CFR 1910.132(d)(2): The employer did not verify that the required workplace hazard assessment has been performed through a written certification which included the requirements as outlined in 29 CFR 1910.132(d)(2):  (a)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020, the employer did not verify that the required workplace hazard assessment had been performed through a written certification in the workplace where employees are exposed to hazards but not limited to lacerations, puncture wounds, chemical exposure, and eye injuries.  The written certification shall include and identify the following:  (1)	The workplace evaluated;  (2)	The person certifying that the evaluation had been performed;  (3)	The date(s) of the hazard assessment; and,  (4)	The document identified as a certification of the hazard assessment.  Abatement Note:  If hazards are present, or likely to be present, the employer must comply with the following:  (1)	Select, and have each affected employee use the types of PPE that will protect the affected employees from the hazards identified in the hazard assessment;  (2)	Communicate selection decisions to each affected employee; and,  (3)	Select PPE that properly fits each affected employee.

29 CFR  1910.132(h)(1):The employer did not provide the protective equipment, including personal protective equipment (PPE), used to comply with this part, at no cost to employees:  (a)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020 the employer did not ensure that employees were provided with protective equipment at no cost to the employees.  Employees were required to purchase nitrile or similar type gloves at their own expense.  Employees were required to use chemicals for maintenance purposes provided by the company that required the use of hand protection in the form of nitrile or equivalent type gloves.  This condition exposed employees to injuries associated with chemical use and potential chemical burns.

29 CFR  1910.215(a)(2): Abrasive wheels used on grinding machinery were not provided with safety guards which covered the spindle end, nut, flange projections:  (a)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702:  On or about and at times prior to November 30, 2020, the employer did not ensure that a Sears Craftsman, Model: 397 19391 bench grinder, was properly guarded in that both end covers of the grinder had been removed.  This condition exposed employees to struck-by hazards associated with grinding operations.

This condition exposed employees to struck-by hazards associated with the grinding wheel.

29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.:   (a)Advanced Auto Repair, Inc. at 1212 Jackson Boulevard, Rapid City, SD 57702: On or about and at times prior to November 30, 2020, the employer did not ensure that compressed air used for cleaning was reduced to less than 30 p.s.i.  A pneumatic air nozzle was identified at 67 p.s.i. and used to clean employees in the shop. This condition exposed employees to struck-by hazards and pulmonary embolism.

Employees were utilizing an acetylene and oxygen torch with damaged hoses.  This condition exposed employees to fire and explosion hazards.
