29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   a.  Facility Manufacturing Area:  Employees engaged in welding operations were required to use a 3M  Half Facepiece reusable elastomeric respirator with particular filter  2091 P100.  The employer provided and required employees to wear the respirator to mitigate welding fumes exposure during the duration of a working shift.  The employer  did not develop or implement a respiratory protection program; on or about 12/1/2020.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a. Facility Manufacturing Area:  The employer provided and required the use of a 3M Half Facepiece reusable respirator with particular filter 2091 P100, while  employees engaged in welding operations for the construction of garment conveyor systems.  The employer did not provide medical evaluations prior to the required use of respirators; on or about 12/1/2020.  Note:  In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

Facility Manufacturing Area:  Employees engaged in welding operations were required to use a 3M  Half facepiece reusable elastomeric  respirator.  The employer  provided and required employees to wear the respirator to mitigate welding fumes exposure.  The employer did not provide qualitative or quantitative fit testing prior to requiring the use of the respirator; on or about 12/1/2020.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1910.134(g)(1)(i)(A): 29 CFR 1910.134(g)(1)(i)[A]: The employer did not prohibit a tight-fitting facepiece to be worn by employees who had facial hair that comes between the sealing surface of the facepiece and the face:   a.  Facility Manufacturing Area:  Employees engaged in welding operations were required to use a 3M  Half Facepiece reusable tight -fitting respirator.  The employees were observed having facial hair that would have interfered with a respirator tight fitting seal around the face; on or about 12/1/2020.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
