29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a)   New residential construction, LOT 313 , Roof:  On or about 12/3/2020, and at times prior, the employer exposed employees to struck by hazards , in that they were operating a Motabo 3-1/4 coil nail gun at 105 PSI  without eye protection while conducting roofing activities.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)     New residential construction, LOT 313, Roof:  On or about 12/3/2020, and at times prior, the employer exposed employees to fall hazards , in that a fall protection system was not provided to employees who were installing trusses from the top plate at heights measured at 24 feet 3 inches to the lower level.   b)     New residential construction, LOT 313 , Second Floor:  On or about 12/3/2020, and at times prior, the employer exposed employees to fall hazards of approximately 12 feet 10 inches, in that  there was no guardrail system installed on the second floor open windows where employees were working conducting framing activities.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) New residential construction, lot 313, Roof: On or about 12/3/2020, and at times prior, the employer exposed employees to fall hazards of 24 feet 3 inches to the lower level, in that the employer did not provide fall protection training to employees working on the roof conducting framing activities. Employees were not trained to recognize fall hazards and how to minimize them.

29 CFR  1926.1052(c)(1)(ii):Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  a)	New Residential construction, first floor:  On or about 12/3/2020, and at times prior, the employer exposed employees to fall hazards , in that the stairway leading to the second floor was not provided with a handrail system. Employees conducting framing activities were utilizing the stairway to gain access to the second floor.
