29 CFR  1926.451(a)(6):Scaffolds were not designed by a qualified person and were not constructed and loaded in accordance with that design.  On or about December 3, 2020, and at times prior thereto, at least two workers were working to unload materials on a job-made, wooden trash box supported by the forks of a Rough Terrain Truck, Model 6042 T4F, Serial No. 0160074663, manufactured in 2016 by JLG.  The trash box was elevated up to approximately eighteen feet of the apartment building under construction, exposing the workers to a fall hazard.

29 CFR  1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms without being specifically designed by the manufacturer for such use:   On or about December 3, 2020, and at times prior thereto, two employees were unloading materials from a job-made, wooden trash box supported by the forks of a rough terrain forklift.  The trash box was elevated up to approximately eighteen feet high of  the apartment building under construction, exposing the employees to a fall hazard.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  On or about December 3, 2020, and at times prior thereto, employees were not trained on the use of a job-made, wooden trash box used as a scaffold to relocate materials from lower levels to higher levels, exposing workers to a fall hazard.

The trash box was elevated up to approximately 18 feet high of the apartment building under construction, exposing employees to a fall hazard.

Note: The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter.  29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  On or about December 3, 2020, and at times prior thereto, the employer did not ensure that the operators of the rough terrain forklift were trained in the safe operations of the forklift, exposing employees to hazards such as, but not limited to being struck by moving objects, struck by falling loads and crushed by forklift tipping.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.   On or about December 3, 2020, and at times prior thereto, two employees were unloading cabinets from a job-made, wooden trash box up to approximately 18 feet high at the  apartment complex under construction without the use of fall protection, exposing employees to a fall hazard.
