29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a. On or about December 2, 2020, employees were exposed to stuck-by hazards, when required to operate Toyota Forklift, Model 7FGCU25, and Serial No. 77066. The power industrial vehicle did not have a functioning horn and was not equipped with factory equipped seatbelt or side view mirrors, and was not removed from service. b. On or about December 2, 2020, employees were exposed to stuck-by hazards, when required to operate Kalmar AC Forklift, Model: P 50BX PS, Serial No. 568159A. The power industrial vehicle did not have a functioning horn and was not equipped with factory side view mirrors, and was not removed from service.

29 CFR 1910.178(q)(7):Industrial trucks were not examined before being placed in service and were placed in service when the examination showed condition(s) that would adversely affect the safety of the vehicle. Examinations were not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. a. On or about December 2, 2020, the employer did not ensure the Toyota and Kalmar AC forklifts were examined prior to use to verify condition.
