29 CFR  1926.651(b)(4):While the excavation was opened, underground installations were not protected, supported or removed as necessary to safeguard employees:  a) Location:  North excavation in sidewalk at the front of 35 Washington Street, in Quincy, MA On November 23, 2020, the employer failed to ensure an upright utility pole within the side wall of an excavation was supported after being undermined, and it was pulled over from the weight of the cables during a rainstorm.  b) Location: South excavation in sidewalk at 35 Washington Street, in Quincy, MA On November 23, 2020, the employer failed to ensure a fire hydrant riser exposed within the excavation was adequately supported.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift.  a) Location: North excavation in sidewalk at the front of 35 Washington Street, in Quincy, MA On November 23, 2020, the employer failed to perform frequent inspections to ensure the soil in proximity of utility poles were not undermined, and did not inspect the soil being washed out during a heavy rain storm, exposing employees to struck by hazards.  b) Location: South excavation in sidewalk at the front of 35 Washington Street, in Quincy, MA On November 23, 2020, the employer failed to perform frequent inspections to ensure water was not accumulating and undermining excavation walls that could cause potential soil surge on to the shoring system in place, or the potential for an unsupported fire hydrant to sink and move suddenly which could cause it to break apart.

Employees were exposed to cave-in hazards where the employer failed to provide a design approved by a registered professional engineer for deviating from the manufacturer's assembly specifications and tabulated data for the modular aluminum panel shields system.
