29 CFR  1926.200(g)(2): All traffic control signs or devices used for protection of construction workers did not conform to Part VI of the Manual of Uniform Traffic Control Devices (MUTCD):  Site- On or about December 2 and 4, 2020 employees driving and working from an elevated bucket of a utility truck; traveling against the flow of traffic in the northbound lane of Route 10, effectively closing the lane and requiring the use of a single lane by traffic approaching from both directions; were not protected from being struck by vehicular traffic where traffic control devices were not in use to coordinate traffic. Part VI of the Manual of Uniform Traffic Control Devices, section 6C.10 requires traffic to be coordinated on each end of the worksite when one-lane is utilized for traffic approaching in both directions. The self-regulating exception to the standard can not be applied because Route 10 is not a low volume road.

29 CFR  1926.201(a): Signaling by flaggers and the use of flaggers, including warning garments worn by flaggers did not conform to Part VI of the Manual on Uniform Traffic Control Devices, (1988 Edition, Revision 3 or the Millennium Edition):   Site- On or about December 4, 2020 an employee flagging in a work zone was exposed to a struck by hazard from vehicular traffic where they were not wearing high visibility clothing that conformed with Part VI of the Manual on Uniform Traffic Control Devices. Section 6E.02 High-Visibility Safety Apparel states that for daytime and nighttime activity, flaggers shall wear high-visibility safety apparel that meets the Performance Class 2 or 3 requirements of ANSI/ISEA 107-2004 High-Visibility Apparel and Headwear. The employee was only wearing background material and lacked either retroreflective material or combined-performance material.
