29 CFR  1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:   On December 8, 2020 for an excavation on a public access crossroad,  the employer did not instruct employees in methods to control or eliminate potential cave-in hazards prior to working in excavations.

29 CFR  1926.651(e): Employees were not required to stand away from any vehicle being loaded or unloaded to avoid being struck by any spillage or falling materials:   On December 8, 2020 for an excavation on a public access crossroad, an excavator of Riverside Development Services, LLC was extracting soil from an  excavation adjacent to an employee manually removing soil from inside the excavation, exposing the employee to a struck by hazard.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  On December 8, 2020 for an excavation on a public access crossroad, an employee removed soil from a casing inside an excavation.  The employer failed to ensure a competent person inspected the excavation for indications of failure to a previously installed, inadequate protective system used by the employer to protect employees from a cave-in.

29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:   On December 8, 2020 for an excavation on a public access crossroad,  the employer failed to remove an employee from working inside an excavation indicating predictable, protective system failure, amongst other unsafe conditions, exposing the employee to disabling injuries and or death.
