29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) Optima Belle, Process Unit: On December 8, 2020, employees were conducting a toll manufacturing drying process on a solid chlorinated product, CDB-56 in a double cone dryer. Employees were exposed to over-pressurization and explosion hazards wile conducting the toll manufacturing drying process in that the chlorinated product decomposed during the drying process.

29 CFR 1910.1200(h)(3)(i): The employee training did not include the methods and observations used to detect the presence or release of a hazardous chemical in the work area: (a) Optima Belle, Process Unit: On December 8, 2020, employees were not provided with training to recognize the signs that a decomposition of CDB-58 had begun. The signs of decomposition would include, but not limited to, presence of yellow/brown porous inert residue, bubbling, smoking, gassing, bulging or hot containers and low pH level in the scrubber.
