1910.178(l)(6) Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation. a) Eagle Railcar Services, LLC, On or about December 08, 2020 at the address of 7570 Ottawa Rd. Cairo, Ohio: The employer did not ensure powered industrial vehicle operators were evaluated for performance every three years. Operators were required to operate the Powered Industrial Vehicle such as Yale and JLG to move products through the facility on daily basis.
