The employee was using a RS8-44 Telescopic Handler with a job made work platform to transport and lift the employee to the roof of the home and the employer did not ensure that the lift was specifically designed by the manufacturer for such use.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about December 7, 2020, employees were exposed to a struck by hazard while performing framing activities on a residential home located at Building 11 Alanson Ave., Akron, Ohio 44313. The employees were using air powered nail guns and the employer did not ensure that they were wearing protective safety glasses. CDM Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1476740, citation number 1, item number 1 and was affirmed as a final order on 7/14/20, with respect to a workplace located at 3899 Red Creek Court, Perry, Ohio 44081.
