29 CFR 1928.57(a)(7)(i): The employer did not protect employees from coming into contact with hazards created by moving machinery parts through the installation and use of a guard or shield or guarding by location: a.) Clamshell Packaging Line - On or about December 9, 2020, employees were not protected from the pinch points created by the cycling of the Ohlson lettuce packaging machine. b.) Clamshell Packaging Line - On or about December 9, 2020, employees were exposed to a caught in and nip point hazards where the right end of the Ohlson indexing conveyor belt was not guarded and fully exposed. c.) Clamshell Packaging Line - On or about December 9, 2020, employees were exposed to caught in and nip point hazards where the left end of the Ohlson indexing conveyor belt and the right end of the Dorner 2200 series conveyor belt are situated approximately 3 inches apart with no guarding.

29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from the weighing head platform: Lettuce Weighing Platform - On or about December 9, 2020, employees were exposed to falls of approximately 13 feet where the guardrail was missing by the sink and not tall enough to protect employees using a stepstool to reach the weighing head. One feasible and acceptable means to abate this violation would be to install an adequate guardrail system in accordance with ANSI/ASSE A1264.1-2007, that covers all areas of the platform, and is high enough to provide protection when employees are using the portable stepstool to access the weighing head.
