29 CFR 1910.147(c)(6)(ii): The employer shall certify that the periodic inspections have been performed. The certification shall identify the machine or equipment on which the energy control procedure was being utilized, the date of the inspection, the employees included in the inspection, and the person performing the inspection. The employer did not certify that the periodic inspection was conducted on the Weinig #1 and authorized employees were familiar with their responsibilities.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about December 9, 2020, employees were exposed to machine hazards associated with moving parts and in-going nip points when they engaged in servicing and maintenance activities on the Michael Weinig GvbH & Co, (Model: 116-20, Mach No 557-908). The employer did not ensure that energy control application steps to control the electrical energy source was implemented prior to allowing employees to perform set up activities on the Michael Weinig GvbH & Co, (Model: 116-20, Mach No 557-908). The machine was not locked out prior to engaging in this servicing and maintenance activity. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards.
