29 CFR  1910.66(i)(1)(ii)(B):  All employees who operate working platforms shall be trained in general recognition and prevention of safety hazards associated with the use of working platforms, including the provisions in the section relating to the particular working platform to be operated.   (a)  On or about December 9, 2020, Dole did not provide training on the general recognition and prevention of safety hazards  associated with the operation of the self-powered platform (JLG Scissor Lift Model 2632ES Serial number 0200248875) that was leased to install new light fixtures in the ammonia mechanical room.

29 CFR  1910.66(i)(1)(iv):  Written work procedures for the operation, safe use and inspection of working platforms shall be provided for employee training. Pictorial methods of instruction, may be used, in lieu of written work procedures, if employee communication is improved using this method. The operating manuals supplied by manufacturers for platform system components can serve as the basis for these procedures.   (a)  On or about December 9, 2020, Dole did not provide written work procedures for operation, safe use and inspection of the self-powered platform (JLG Scissor Lift Model 2632ES Serial number 0200248875) that was used to perform building maintenance in the ammonia mechanical room.

29 CFR  1910.119(e)(5): The employer shall establish a system to promptly address the team's findings and recommendations; assure that the recommendations are resolved in a timely manner and that the resolution is documented; document what actions are to be taken; complete actions as soon as possible; develop a written schedule of when these actions are to be completed; communicate the actions to operating, maintenance and other employees whose work assignments are in the process and who may be affected by the recommendations or actions.  (a)  On or about December 10, 2020, the employer did not ensure that 18 of the 36 findings from the Ammonia Process Hazard Analysis Recommendations  were addressed and that the resolutions were documented on the What-If Checklist for the PHA that was completed January 10, 2019.

These safe work practices shall apply to employees and contractor employees. (a)  On or about December 9, 2020, the employer did not complete a management of change review of the replacement of  the overhead, round, Halide Halogen 400 watt overhead fluorescent light fixtures in the mechanical room with new, rectangular, T5 LED 25 watt light fixtures.
