29 CFR 1926.503(a)(1): The employer did not train each employee who might be exposed to fall hazards to enable them to recognize fall hazards and the procedures to be followed in order to minimize these hazards:  a) 401 Naamans Road, Tri-State Mall, Claymont, DE: On or about December 11, 2020, the employer failed to train employees engaged in construction activities in the recognition and avoidance of unsafe conditions related to worksite conditions posing a potential fall hazard.  Abatement Note:  1. Fall protection training is required for employees before they begin tasks where they have potential exposure to fall hazards and before they use fall protection systems.  Retraining is required when employees don't recognize fall hazards, when they don't follow safe practices for using fall protection systems, and when changes in the workplace or in the fall protection systems used make their previous training incomplete or obsolete.  2. The employer is required to designate a competent person; that is, a person having management authority to control employees and one who can identify work-site hazards.  3. The trainer must know and be able to explain the following: - The nature of fall hazards at the work site; - Procedures for erecting, maintaining, and disassembling fall protection systems; - How to use and operate fall protection systems; - The role of each employee who may be affected by a safety-monitoring system; - The restrictions that apply to mechanical equipment used during roofing work; - The procedure for handling and storing materials and for erecting protection from falling objects; and, - The applicable requirements of Subdivision M for the type of fall protection systems used.  4. The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.

29 CFR 1926.602(c)(1)(ii):  Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:  (a) 401 Naamans Road, Tri-State Mall (two-story fa�ade mock-up building under construction), Claymont, DE: On or about December 11, 2020, the employer failed to provide a manufacturer-approved personnel safety platform to elevate employees who, instead, were elevated perpendicular and adjacent to the side wall of this building while standing inside a makeshift wooden trash box insecurely attached to the forks of an Extreme Manufacturing Telehandler.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:   (a) 401 Naamans Road, Tri-State Mall (two-story fa�ade mock-up building under construction), Claymont, DE: On or about December 11, 2020, the employer failed to provide a fall protection system to employees exposed to a fall hazard while:  1) elevated perpendicular and adjacent to the side wall of this building while standing inside a makeshift wooden trash box insecurely attached to the forks of an Extreme Manufacturing Telehandler; and,  2) walking and working on the second floor having unprotected edges.  Mid Ulster Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 1151891, citation number 1, item number 2, and was affirmed as a final order on 9/26/2016, with respect to a workplace located at 290 Polifly Road, Hasbrouck Heights, NJ 07604.  Mid Ulster Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1151891, citation number 1, item number 3, and was affirmed as a final order on 9/26/2016, with respect to a workplace located at 290 Polifly Road, Hasbrouck Heights, NJ 07604.
