OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the collapse of buildings:   a.)  On or before December 9, 2020, located at 14869 U.S. Highway 52, Manchester, OH 45144, the employer did not ensure the cutting operations in preparation for explosive demolition were directed by a structural engineer or competent person qualified to direct the removal of structural elements, exposing employees working within and around the structure to crushing/struck-by hazards.  Among other methods, one feasible and acceptable method to correct this hazard includes, but is not limited to the following:   Compliance with the National Demolition Association Standard 11.0 - Safe Blasting Procedures, Blasting Survey Section (Page 182), which gives guidance for the preparation of a structure for demolition as follows:   The use of explosives to demolish entire buildings should be done by specialty contractors. The preparation of a structure for demolition by explosives may require the removal of structural columns, beams or other building components. This work should be directed by a structural engineer or a competent person qualified to direct the removal of these structural elements. Extreme caution should be taken during this preparatory work to prevent the weakening and premature collapse of the structure.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.)  On or before December 9, 2020, located at 14869 U.S. Highway 52, Manchester, OH 45144, SCM Engineer Demolition, Inc. did not ensure that SCM and Adamo employees were instructed in the recognition and avoidance of unsafe conditions or other hazards while conducting explosive preparation such as structural columns being cut to weaken and direct the collapse of columns in a predetermined direction and conducting demolition processes such as working from ground level to cut structural columns exposing employees and those working around them to struck-by and crush hazards.

29 CFR  1926.859(g):During demolition, continuing inspections by a competent person shall be made as the work progresses to detect hazards resulting from weakened or deteriorated floors, or walls, or loosened material. No employee shall be permitted to work where such hazards exist until they are corrected by shoring, bracing, or other effective means.  On or before December 9, 2020, located at 14869 U.S. Highway 52, Manchester, OH 45144, when SCM Engineer Demolition, Inc. and Adamo were demolishing the boiler plant to a state of near collapse and SCM's competent person was informed of hazards such as but not limited to, twisted/bowed columns and unusual settling noises within the building, SCM's owner/operator Steve Murray did not ensure employees were restricted from accessing the hazardous area until the hazards were corrected.
