29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a) On or about December 11, 2020, employees were exposed to the hazard of falling objects when working below employees installing a roof.  The employees were not wearing hard hats.  b) On or about December 15, 2020, employees were exposed to the hazard of falling objects when working below employees installing a roof.  The employees were not wearing hard hats.  No abatement certification or documentation is required for this item.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   a) On December 11, 2020, at the above addressed jobsite, employees conducting installation of a roof on a two story residential home, at twenty-two (22') feet above the ground, were not utilizing personal fall  arrest systems or other means of fall protection when performing the roofing operations, thereby exposing the employees to fall hazards.  b) On December 15, 2020, at the above addressed jobsite, employees conducting installation of a roof on a two story residential home, at twenty-two (22') feet above the ground, were not utilizing personal fall arrest systems or other means of fall protection when performing the roofing operations, thereby exposing the employees to fall hazards.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
