29 CFR OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease, which can cause death. a) Avantor Fluid Handling LLC - 38 Industrial Way E #5th, Eatontown NJ 07724: The employer did not ensure and enforce established social distancing protocols. Employees using common work areas such as the break room, locker rooms, and gowning room did not maintain at least 6 ft. of distance between themselves and their co-workers. Employees took their masks off to eat in the break room, and took them off in the locker rooms and gowning room when they were changing masks. The employees were exposed to co-workers infected with SARS-CoV-2 (COVID-19). Occurred on or about November 14, 2020 and thereafter. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
