29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On December 9, 2020, for the employees exposed to fall hazards of approximately 50 feet while installing roof vents on a five story residential apartment roof without the benefit of fall protection systems at or near 215 South First Street in Bismarck, North Dakota. Note: Abel Cabrera Cunyas was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1459366, Citation 1, Item 1, and was affirmed as a final order on March 12, 2020, with respect to a workplace located in the vicinity of Burleigh Avenue and Kingsford Drive in Bismarck, North Dakota.
