29 CFR 1910.134(a)(2): On or about November 13, 2020 through December 13, 2020, the employer did not provide appropriate respirators when necessary to protect employee health:   (a) Trinity Services, Inc. located at 239 Park Avenue in Wheeling, Illinois, 60090:  On or about November 13, 2020 through December 13, 2020, the employer did not provide employees with an appropriate N95 respirator necessary to protect employees from SARS-CoV-2 virus when providing care to COVID-19 positive residents.  Employees were provided a filtering facepiece protection labeled "Garry Galaxy N95" that was neither NIOSH-certified nor an internationally-certified equivalent approved under the Emergency Use Authorization.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
