On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was working on scaffold below employees who were handling tools and metal materials without utilizing head protection equipment.

29 CFR  1926.451(b)(1)(ii):  Where the employer makes the demonstration provided for in paragraph (b)(1)(i) of this section, the platform shall be planked or decked as fully as possible and the remaining open space between the platform and the uprights shall not exceed 9 1/2 inches (24.1 cm).  a)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from fabricated frame scaffolding at twelve and one half feet above surface level without a fully decked platform.  One nineteen inch wide plank was installed between the end frames with a forty inch opening between the plank side edge and upright's cross bracing.  b)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was working from fabricated frame scaffolding at eleven and one half feet above surface level without a fully decked work platform.  One nineteen inch wide plank was installed between the end frames with a forty inch opening between plank side edge and upright's cross bracing.  c)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was working from fabricated frame scaffolding at five and one half feet above surface level without a fully decked platform. 29 CFR  1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.  On or about December 8, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees installing soffit and fascia on two garages were working from scaffold work platforms at greater than ten feet without the platform at least eighteen inches wide.  Employees were utilizing fourteen-inch wide aluminum stage planks supported on each end by a scaffold tower.

29 CFR  1926.451(e)(6)(i):  Integral prefabricated scaffold access frames shall be specifically designed and constructed for use as ladder rungs.  a)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was climbing on a top bar of a scaffold end frame eleven and one half feet above surface level to continue climbing down and over to the access/egress rungs.  Scaffold near the building's northwest corner did not have end frame rungs constructed for direct access/egress of the work platform.  b)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was climbing on the inside of end frames to access/egress a work platform twelve and one half feet above surface level.  Scaffold near the building's northwest corner did not have end frame rungs constructed for direct access/egress of the work platform.  c)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was climbing on a top bar of a scaffold end frame five and one half feet above surface level to continue climbing down access/egress rungs.  Scaffold near the building's northwest corner did not have end frame rungs constructed for direct access/egress of the work platform.  d)  On December 8,  2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, an employee was climbing on a top bar of a scaffold end frame greater than ten feet above surface level to continue climbing down and over to the access/egress rungs.  Scaffold near the building's northeast corner did not have end frame rungs constructed for direct access/egress of the work platform.

29 CFR  1926.451(g)(1)(vii):  Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level.  For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from a scaffold platform at twelve and one half feet above surface level without utilizing conventional fall protection equipment on the gable end of the garage.  b)  On December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from a scaffold work platform at eleven and one half feet above surface level without utilizing conventional fall protection equipment on the gable end of the garage.  c)  On or about December 8, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, employees were working from scaffold planks at greater than ten feet above surface level without utilizing conventional fall protection equipment on the long sides of the garage.

29 CFR  1926.454(a)(1):  The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the nature of any electrical hazards, fall hazards and falling object hazards in the work area;   On and about December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, the employer did not provide required scaffold use safety training for employees exposed to fall hazards greater than ten feet while installing metal siding, soffit, and fascia from scaffold platforms.

The training shall include the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question.  On and about December 10, 2020 at 9369 Thoroughfare Road in Minocqua, Wisconsin, the employer did not provide required scaffold assembly/disassembly safety training for employees erecting fabricated frame scaffold using seven-foot and twenty-foot long planks.
